Residents are limited to three (3) total pets, two (2) of which may be non-aggressive dogs. Small, domesticated birds in cages and fish may be kept in reasonable numbers, but such pets must not be raised for commercial purposes.

(A) No dangerous or vicious breeds will be allowed on the Property. If the Board determines a pet is dangerous or vicious or otherwise unreasonable to other residents the Owner shall be required to immediately remove said pet from the premises.

(B) All animals shall be contained on the Owner’s Lot and shall not be permitted to run freely unless within the Lot’s fenced enclosure. When outside the Owner’s Home, all pets must be kept on a hand-held leash or carried at all times. Pet owners shall at all times be in control of their pets and not allow them to be a threat (perceived or actual) or source of nuisance to other residents and their guests or invitees.

(C) All pet owners are obligated to clean up after their pet. Messes made by pets shall be removed by Owners or handlers immediately and deposited into the Owners’ respective garbage receptacle only.

(D) Pets are not permitted in the Clubhouse, pool area, tennis courts or the playground.

(E) All pets must be registered before coming into Black Bear Ridge.

A Lot (home) may not be rented or leased until the Owner has held title to the Lot for at least twelve (12) months. In the event of a change in ownership of the Lot during the term of an existing lease, upon the expiration of the existing lease the Lot cannot be rented or leased until after the twelve (12) months immediately following the expiration of the lease. At that time, the Lot is treated as any other Lot in the community as it relates to the limit on lease/rental Lots. All leases must be approved by the Association in writing prior to the occupancy date.

Approval and Disapproval of Leases The following procedures shall apply when an Owner intends to lease his Lot:

(A) An Owner must give the Association thirty (30) days’ advance written notice of any proposed lease. Owners must fill out a completed lease application, including all application and background report fees to the property manager.

(B) Owners must provide written confirmation that the lessees have received copies of the Association’s rules and regulations and have agreed to comply with same upon taking occupancy in Black Bear Ridge. Owner and lessee shall complete and return Association lease addendum.

(C) The Lot and Owner must be in compliance with all applicable rules and covenants at the time of the transfer and all amounts and assessments owed to the Association must be paid before approval can be granted.

(D) No Living Unit may be used on a “time share” basis. Advertising or publishing a Lot for daily or weekly lease or license, regardless of whether the arrangements are classified or described as something other than a lease, is prohibited. “Leasing” herein specifically includes, but is not limited to, arrangements such as those facilitated by Airbnb, Flip Key, Craigslist.com, VRBO, Tripping.com, House Trip, Luxury Retreats, HomeAway or any similar sites, regardless of whether the arrangements are classified or described as something other than a lease, (for example but without limitation, classifying the arrangement as a license, rental, guest occupancy or use right). Without limiting any other Association remedies for violations, all Owners are hereby deemed to authorize the Association to send a copy of this provision to any applicable leasing agent or realtor, or to the publisher or operator of any such sites or media outlet, as instruction that the advertisement be immediately removed.

(E) No more than five (5) Lots in Black Bear Ridge may be leased or rented at any given time. The five (5) Lots eligible to be leased or rented will be determined as follows:

• The five-Lot lease/rental cap shall be determined on a first come, first served basis. In the event an owner wishes to lease/rent his or her Lot, he or she must notify the Board in writing, and provide a $500 non-refundable deposit. When the lease/rental application is submitted and if approved, the deposit will be credited toward the fees. The owner must make a good faith effort to submit a lease/rental application for approval within sixty (60) days of being notified by the Association that he/she can lease/rent his or her Lot. The $500 non-refundable deposit, less any administrative fees to perform the background and credit screening, shall only be returned in the event the owner submits a lease/rental application for approval within sixty (60) days, and the Association disapproves the lease/rental.

• If a lease/rental application is not submitted for approval within sixty (60) days of notification from the association, the written request and non-refundable deposit will be forfeited to Black Bear Ridge and the next owner requesting to lease/rent will be eligible.

• If the lease/rental cap has already been met, then the owner making the written request will be placed on a waiting list and notified when a lease/rental spot becomes available. Owners will be placed on the waiting list in the order in which his or her written request is received with a $500 non-refundable deposit.

• Upon termination or expiration of a lease/rental, if the owner wishes to lease/rent his or her Lot, they must notify the Board in writing with a $500 non-refundable deposit, and then will be placed at the bottom of the waiting list for the next availability.
