I'm not a lawyer but I can tell you that there are laws in place that could land you in hot water if you're caught, even on your own property. According to attorney Tim Flaherty, "It might seem innocent to swim or sunbathe in the nude, but these actions are illegal under Florida law." Of course, I think most neighbors would turn a blind eye yet is it worth the risk? He goes on to say that "A sex crime conviction can follow you for the rest of your life, so it’s vital to take these charges seriously."

The Naples Daily News wrote an article and mentioned that calls about indecent exposure in Naples are very rare. Is it worth the chance? That depends on how private your lanai is!

Can the Neighbors See You From Their Land?

I once had a listing in Riverstone with a pool outside overlooking the lake. It was a beautiful home and the swimming pool was fantastic yet it was a very difficult sale to make. The reason was that on both sides of this listing, neighbors were right there with second story windows and you'd often see them on their lanai or balcony thus eliminating any privacy. I remember thinking that even in a bathing suit, I would feel I was in a fishbowl.

My Own Experience with Skinny Dipping in Naples

Fast forward to when my wife and I bought our current home. We are lucky to have an incredible lanai that is 100% private. Between my home and the neighbors on either side are walls of clusia shrubs about 12' high that make a perfect privacy fence for our pool. Straight ahead is a preserve where nobody passes through.

This begs the question--why would we need a bathing suit? Now that I have owned a home with a 100% private lanai, I can't imagine not having that privacy. I even bought a "clothing optional" sign for the lanai that always tends to start conversations when friends come by. When the topic comes up, we have more and more people admit to doing the same. Unfortunately, not all of them have the privacy they need to really be safe.
