Some homes are on the lake.

1. Only unit Owners and approved Tenants shall be permitted to keep no more than two small dogs or cats only if such pets do not disturb or annoy other unit Owners. Pets must weigh less than twenty-five (25) pounds each. Unit Owners keeping such pets shall abide by municipal sanitary regulations and shall be responsible for any inconvenience or damage caused by such pets.

2. Guests as defined herein shall not be permitted to bring pets onto the condominium Common Elements or into any condominium unit.

3. All pets shall be kept on leashes when not confined to the Owner or Tenant’s unit

4. Pet Owners must clean up any waste made by their pets and such waste must be deposited in a dumpster.

5. If, in the sole judgment of the Board, it is determined that a pet is causing excessive disturbance and annoyance to other occupants, the owner shall remove the pet from the premises.

6. Pets shall not be allowed in the swimming pool areas, Clubhouse, or rear Pool Pavilion.

7. No livestock, reptiles, or poultry, non-domestic or wild animals of any kind shall be raised, bred or kept in any unit, the common elements or the limited common areas.

1. No Owner, Tenant, or other Occupant of a condominium unit shall use the unit for other than singlefamily residence purposes (either Owner occupancy or Lease).

2. Owners shall not permit anything to be done which is a nuisance, such as excessive noise, interference with the right of other owners, increased risk, and liability, or commit immoral or illegal acts within The Villages of Emerald Bay.

3. Owners and their families may use Units for a “Home Office and “Telecommuting” purposes, provided that such uses do not involve customers or clients coming onto the condominium property, the posting of any signage in the condominium, the storage of equipment, products or materials in the condominium, nor more than 2 regular deliveries per day of correspondence or similar items from customary delivery services (excluding regular mail services).

4. Tenants may not use their Unit for any commercial or business purpose whatsoever.

5. The ultimate responsibility (financial or otherwise) for the behavior and rule compliance by Family, Guests, Tenants, and Visitors rests with the unit Owner.

6. Unit owners, when contemplating leasing or otherwise allowing occupancy of their unit, must completely familiarize themselves with Section 14 Leasing, in the Second Amended and Restated Declaration of Condominium as well as these Rules and Regulations.

7. Unit Owners may not rent or lease their unit for less than ninety (90) days to any one Tenant.

8. In the event that no lease exists between the Owner and the Tenant, an alternative tenancy agreement and an alternative tenancy addendum (similar in format to the lease addendum) must be on file.

9. Both Seasonal and Annual Tenants are required to submit to a criminal records and other required background checks and pay the required $150 fee as a precondition to occupancy.

10. Prior to allowing a Tenant to occupy a unit, the owner must have the required $700 common elements security deposit on file with Emerald Bay.

11. There are no visitation restrictions for Guests occupying a unit when the Owner is in residence as long as it does not exceed 30 days.

12. No unit may be leased more than two (2) times per calendar year.

13. All leases and tenancy or occupancy agreement shall be in written form and must be submitted to the Association no less than 30 days prior to implementation. Approval by the Association is a precondition to occupancy by any Tenant. The Lease or Occupancy Addendum required by the Board must also be properly executed and filed with the Office.

14. A unit Owner shall lease only the entire unit.

15. The Tenant must be one natural person (as opposed to a legal person or entity).

16. Time requirements for lease applications, as stated in Section 14 of the Amended and Restated Declaration of Condominium and these Rules and Regulations will be strictly enforced.

17. All of the provisions in the Condominium Documents and the Rules and Regulations of the Association shall be applicable and enforceable against any person occupying a unit as a Tenant or Guest to the same extent as against the Owner.

18. The unit Owner is not permitted to use the Association’s amenities during the term of the rental or alternative tenancy of his unit.

19. A copy of a Lease Renewal or Month-to- Month agreement signed by both Owner and Tenant must be submitted to the Association Office each year 30 days prior to the Original Lease end date.
