An Owner may keep one (1) pet of a normal domesticated household type (such as cats or dogs) in the Unit. Tenants and Guests are prohibited from keeping pets. No pet may be more than twenty-five (25) pounds at maturity. Notwithstanding the foregoing, under no circumstances shall a “Pit Bull”, Rottweiler, Doberman Pinscher, Presa Canario (canary dog), or “Dangerous Dog” be permitted on the Property. No reptiles, monkeys, rodents, amphibians, poultry, swine, rabbits, ferrets, or livestock may be raised, bred, or kept on the Properties. Pets must be leashed at all times when outside the Owner’s Unit. The ability to keep pets is a privilege, not a right, and the board of Directors is empowered to fine an Owner and/or order and enforce the removal of any pet that becomes a source of unreasonable annoyance or a danger to the health, safety and welfare, in the Board’s sole and absolute discretion, to other Residents with five (5) days’ notice to the Owner. All animals kept in the Unit must be for personal family enjoyment as pets, no commercial breeding or boarding of animals of any type is allowed. The Person walking the pet or the Owner shall clean up all matter created or caused by the pet. The Association may restrict the walking of pets to certain areas, pets may not be left unattended on porches, patios or in garages, and commercial activitiesinvolving animalsshall not be allowed. All pets must comply with any and all vaccination requirements and any local, state, and federal regulations regarding pets. Any Person who keeps or maintains an animal shall, in exchange for and in consideration of the privilege to keep the animal, hereby indemnify and hold the Association free and harmless from any loss, claim, or liability of any kind or character of whatever nature arising from or related to the keeping or maintaining of such animal in the Unit. The Association, in its sole and absolute discretion, may enact further restrictions regarding the keeping of pets in the Association and the Units.
As used in this Declaration, a “Pit Bull” is defined as any dog that is an American Pit Bull Terrier, American Staffordshire Terrier, Staffordshire Bull Terrier, or any dog displaying a majority of the physical traits of any one (1) or more the above breeds, or any dog exhibiting those distinguishing characteristics which substantially conform to the standards established by the American Kennel Club or United Kennel Club for any of the above breeds; and a “Dangerous Dog” is defined as a dog which meets any one (1) of the following criteria: (a) has aggressively bitten, attacked, endangered, or has inflicted severe injury on a human being at any time whether on or off the Property, (b) has severally injured or killed a domestic animal at any time whether on or off the Property, or (c) has, when unprovoked, chased or approached any Person upon the Property in a menacing fashion or apparent attitude of attack; provided, however, a dog shall not be a “Dangerous Dog” if the threat, injury, death or damage was sustained by a Person who, at the time, was unlawfully on the Property (or any portion thereof), or, while lawfully on the Property (or any portion thereof) was tormenting, abusing, or assaulting the dog or its owner or a family member provided further, that no dog may be a “Dangerous Dog” if the dog was protecting or defending a human being within the immediate vicinity of the dog from an unjustified attack or assault. If the pet’s breed is in question, the Association has the right to request that the pet owner submit his pet to a DNA test and such pet owner agrees the result with the majority line of breed listed will be the determining breed of the pet in question. The DNA test is at the cost of the pet owner.
