Pets and Animals, Ordinary household pets (limited to cats, dogs, tropical fish, and small birds in cages) in reasonable numbers may be kept by Residents, Pets shall not be permitted to roam free on the Common Areas, The Master Association may restrict the walking of pets to certain areas, Residents who walk their pets on Common Areas must clean up after their pets. Commercial activities involving animals, such as breeding, training, boarding and veterinary services are not allowed, The ability of a Resident to keep pets is a privilege, not a right, and may be revoked if It is abused. If, in the opinion of the Board, any pet becomes a source of unreasonable annoyance to others, or if the owner of a pet fails or refuses to comply with these restrictions, the Resident, upon written notice, may be required to remove said pet from the Community. No reptiles, amphibians, rodents, poultry, swine or livestock may be kept in the Community, Neighborhood Associations may adopt and enforce pet restrictions which are stricter than those contained in this Master Declaration,
Under no circumstances will the Board give permission for pets other than those permitted by the Master Declaration to be kept in Carlton Lakes.
Each person keeping a pet shall indemnify the Master Association and hold it harmless against any loss or liability of any kind arising from or growing out of keeping such a pet.
Pets must be on a hand-held leash, carried or leashed in a stroller when outside of a Home/Living Unit, Pets are not to be fastened by leash or other means to any fence, building or any other structure,
The pet owner or another responsible person must be present at all times when a pet is outside of a Home/Living Unit,
No pet shall be confined to the lanal of a Home/Living Unit and no pet food shall be placed in the lanal unless the Owner or other responsible person is present in the Home/Living Unit. No pet may be tied up outside of the Home/Living Unit.
The pet owner shall Immediately pick up and dispose of solid waste. It Is the respectability of the pet owner to dispose of waste In a proper manner. No waste ls to be disposed In the lakes or sewers,

These rules are promulgated pursuant to the authority granted to the Board of Carlton Lakes Master Assoclatlon by the Master Assoclation's Governing Doouments, specifically with respeot to authority to adopt rules and regulations governing use and enjoyment of the Community Common Areas. Applicants for exolusive use of portions of the Common Areas are advised that the Board may deny a request for any reason that, in the judgment of the Board, would reasonably Interfere with the use of the Common Areas by other Community Residents, In no event shall all of the Common Areas be subjeot to the exolusive use for a period In excess of seyen consecutive hours. Residents renting the Clubhouse must be in attendance during the entire set-up, event and clean-up of the event,
Residents shall make the request for use to the Board at least two weeks in advance of the intended date of exclusive use, The Board has delegated initial review of requests for exclusive use to Gulf Breeze Management Services of SW FL, LLC, (the "Manager"), The Manager may be reached at 239-498-3311 Monday through Friday, 8:30 A.M, to 4:30 P.M., and will consider reservations in the order received, The Manager's address is 8910 Terrene Court, Suite 200, Bonita Springs, FL 34135, The Board's approval, If granted, must be ln writing from the Board, If the Manager disapproves a request on grounds other than conflict with a prior reservation, the Board may reconsider the disapproval if requested by the Resident,
The Resident using the recreational facllities shall deposit two cheoks payable Carlton Lakes Master Assoolation at the time of submitting the Facility Use Agreement. One oheck in the amount of $150,00 and another cheok for $200,00, The oheok for $200,00 ls a securlty deposit and will be returned to the Resident after the Clubhouse is Inspected by the Property Manager and/or Rental Faclitator. The oheck for $150,00 is a non-refundable rental fee. Resident's Habllity is not Limited to the amount received for the security deposit.
The Master Association may require additional assurances, or impose additional requirements, as a condition of approval for any specific use.
The Resident shall be responsible for, and provide for all clean-up of, facilities used, Ifthe Master Association has to olean up after any private soolal activity, the Resident will be responsible to reimburse the Master Association for all costs.
The Resldent is responsible for notifying the Master Assoolatlon of any pre-existing facility damage prlor to use. The burden of proof that the Resident or Resident's Guests was not responsible for the damage is the Resident's obligation.
Only table and/or floor decorations are permitted, No taping, tacking or pinning items to the walls, mirrors, cornices, door's or existing Clubhouse wall décor' is allowed. No lit candles are to be used as decorations, No items are to be suspended from the ceiling, Clubhouse furniture shall not be removed from the premises, nor moved outdoors or onto the lanai, Any furniture that has been moved within the Clubhouse shall be returned to its original position,
No commercials sales of any kind are permitted, For example Tupperware, candles or jewellery sales are not permitted.
The Resident shall:
A) Be responsible for damages to the Common Areas inflloted by Resident's Guests.
B) Advise his/her Guests of all ourrent rules relating to the use of the recreational faoliitles,
C) Limit the number of persons to 100,
D) Comply with all Master Association rules and governmental ordinances and any speclal requirements concerning alcohollc beverages Imposed by the Board,
E) Use all reasonable efforts to prevent damage to the private property of other Residents or other serlous obatruction of the rights of other Residents.
If approval Is granted, the Resident shall post a notice (provided by Gulf Breeze Management) ofthe Intended perlod of excluslve use at the locatlons specified by the Board. In the event that an appropriate approval is obtained, the Board shall have no obligation to take further measures to exclude persons who have a general right to use the Common Areas. The only remedy of the Resident with exclusive use privileges shall be to petition the Board to Impose one or more sanctions against the offending Resident as provided in the Carlton Lakes Master Associatlon Goveming Doouments for vlolation of Master Assoclation Governing Documents.
Resident and organization shall indemnify the Master Assoclatlon against any and all liability, loss or damage which may suffer as a result of damages, clalms, demands, costs or Judgments against the Master Association arising out of use of the Community facilities by Resldent during the period of approyed exolusive use, as described below (or untl Resldent has completely terminated the use contemplated by this agreement, Including clean up,) Should it become necessary for purposes of defending, adjusting or compromlsing any clalm or demand as a result of the subject matter of this agreement, or for the purpose of enforoing thls agreement, for Carlton Lakes Master Assoclatlon, to Incur any expenses or to become obligated to pay any attorheys' fees or court oosts, Resident agrees to reimburse Cariton Lakes Master Assoclation for such expenses, fees and costs.
Rental specifically excludes use of the exercise room, pool, spa and pool area, dock, booce and tennis courts.
Premises will be available for rental not to exceed seven (7) consecutive hours between the hours of 10:00 AM and 10:00 PM. The seven (7) consecutive hour period is to Include set-up, decorating, event and clean-up, If the premises are not vacated by the "Ending Time" on the Rental Agreement, a $25 Penalty Late Fes will be deducted from the Resident's Security Deposit. Set-up and/or decorating cannot begin before the "start time" on the Rental Agreement.
A Rental Facilitator will be assigned to each rental event. The Resident shall meet with the Rental Facilitator at the start of the set-up time and again at the end of the event to revlew a cheok llst (provlded by the Facilltator) verifying the condition of the premises. Check-out must be completed by both Resident and Facilitator on the same day/night of the event.
Any party that will have more than 50 guests in attendance must have a Certified Crowd Control Manager present during the event per North Collier Fire Department. Contact Gulf Breeze Management Services for Information to contact Statewide Security to provide this seryice at the resident's expense,
Gate Code - Gulf Breeze Management Services will provlde a speclal Gate Code for the Resident to give to their Guests to use to enter the community, This Gate Code will be valid only for the day of the event, THE RESIDENT IS NOT TO PROVIDE THEIR PERSONAL GATE CODE TO THEIR GUESTS OR POST A GATE CODE AT THE GATEHOUSE.
