Port Au Villa is a ‘pet-free’ community. Pets are not permitted on the premises. See the Board for questions about service animals.

For purposes of this document, the definition of a “lease” includes:

• A commercial lease, i.e., when an Owner contractually leases their unit for a specific period in exchange for financial payment, or

• Allowing the unit to be used by extended family, such as cousins, nieces, nephews, aunts, uncles, anyone who is not first-degree family, or

• Allowing the unit to be used by friends

In all scenarios in which an Owner allows occupancy to anyone other than first-degree family, the use of the unit will be treated as a lease and subject to provisions below.

a. One-Year Wait Period: According to the Bylaws, an Owner must wait one year after their purchase to lease their unit. The Board will not approve any formal commercial leases within one year of the purchase or transfer date.

b. Permissible Frequency: The number of leases shall be limited to three in any calendar year.

c. Minimum Lease Period: A lease may not be made for a period of less than 60 days or 2 calendar months. If a lessee vacates a leased unit prior to 60 days and the lease is terminated, no other individual may occupy that unit for the remainder of the lease period, except the Unit Owner and their guest(s) when the Owner is present.

d. Maximum Lease Period: A lease may not be made for more than six (6) months. Furthermore, a lease may not be extended or renewed for any additional period.

e. No Subleasing: A lessee may not sublease or assign their lease rights, nor shall the unit be loaned to anyone in the lessee's absence.

f. Further Limits:

• The apartment may be leased to only one family at a time.

• Overnight guests of lessees are allowed if the lessee and/or his or her family who are approved to occupy the unit are present and shall be limited to one week, (7) days total, per month.

• If the lessee and/or his or her family who are approved to occupy the unit are not present, no other person may occupy the unit.

g. Compliance with Bylaws: Lessees must comply with all PAV Rules & Regulations, Bylaws, and governmental regulations concerning the use of the leased premises. Lessees shall not commit or permit any illegal act to occur on the leased premises. Furthermore, lessees shall not make any disturbance, noise, annoyance or action whatsoever which would be detrimental to the peace and comfort of other persons in the vicinity of the leased premises as determined by the Board.

h. Owner is Responsible: The Owner is responsible to ensure that lessees are informed of the PAV Rules. If any infractions occur, the Owner is responsible to abide by the enforcement measures, as defined by these Rules & Regulations and Bylaws.
