A service animal or companion animal may be permitted as a reasonable accommodation under the Americans with Disabilities Act (ADA) law. A unit owner must submit appropriate documentation to the condo Board of Directors PRIOR to occupancy. A service animal does not require Board approval since by law they are individually trained and certified whereas companion animals are not. However, all necessary documentation must be provided to the Property Manager in the case of either a service animal or a companion animal. The Board has the discretion of reviewing the type of companion animal and determine if the request is a reasonable accommodation. The Board has 14 calendar days to respond to the request for occupancy of a companion animal.

The Declaration of Condominium was amended, on the basis of membership vote at the 2015 Annual General Meeting, to restrict any new owner from renting his/her unit during the first 3 years of ownership. After 3 years, the owner is eligible to rent subject to the restrictions on number of unit that may be rented.
No more than ten (10) units shall be rented at the same time. A waiting list will be maintained by the Property Manager if there are additional owners wishing to rent their unit. Appendix C, Intent to Rent Administrative Procedure, contains a description of the new Intent to Rent list and the implementation procedure associated with it. Board approval is required in all phases of the procedure.
A rental lease may not be for more than one year or less than ninety-one days. Sub-leasing of any unit is strictly prohibited. Renters may not allow anyone to complete their lease if they decide to vacate before the termination date of their rental agreement. No unit may be rented more than once in any twelve month period. Leases are valid for no more than a year. Renewals must be submitted to the Property Manager. For renewals of the same party no additional application fee is required but there may exist a waiting list for rental of units and Board approval is required.
No unit shall be rented to a corporation. Ownership of units is restricted to individuals, otherwise a Primary Occupant must be formally identified and approved by the Board. A "Primary Occupant" means the natural person approved for occupancy when title to a unit is held in the name of two or more persons who are not husband and wife, or by a trustee or a corporation or other entity which is not a natural person. Any change in the primary occupant shall be treated as a transfer of ownership by sale or gift subject to the provisions of Section 14 of the Declaration of Condominium. No more than one such change will be approved in any twelve (12) month period.
All of the provisions of the condominium documents and the rules and regulations of the Association shall be applicable and enforceable against any person occupying a unit as a lessee or guest to the same extent as against the owner. A covenant on the part of each occupant to abide by the rules and regulations of the Association and the provisions of the condominium documents, designating the Association as the owner’s agent with the authority to terminate any lease agreement and evict the tenants in the event of breach of such covenant, shall be deemed to be included in every lease agreement, whether oral or written, and whether specifically expressed in such agreement or not.
Units shall be occupied by no more than two adults per bedroom.
No person may hold legal or beneficial title to more than two (2) units in the Condominium.
There is a non-refundable $150 application fee, payable by the buyer or firsttime renter, on or before the approval interview. The Board will maintain confidentiality of all information contained in the application.
So that references may be checked, a minimum period of ten (10) business days must be allowed after the receipt of the application and before the interview.
Unit owners are responsible for actions of their renters or guests whether or not the owner is in residence. 465 It is expected that unit owners make sure renters or guests are aware of, and comply with the Heron Club "House Rules".
Owners may be fined or renters may be denied occupancy if any of the above regulations are violated.
Owners must provide the Property Manager with a current set of keys so that emergency access can be accommodated. Failure to do so may result in forced entry with the attendant costs being the responsibility of the unit owner.
