Except for birds or fish, in a cage or aquarium located within a Unit, no pets of any kind are permitted in the Condominium Units or on the Common Elements of the Condominium at any time.

No Lease shall be made until and unless it has been approved by the Board or its designee. (Decl. Sec. 18.7.1-18.7.3)

No Unit shall be leased more than once each year for a maximum of twelve (12) months. (Decl. Sec. 17.9) The year shall be determined by the date of the first day of the Lease. If the Lease spills over into a second calendar year, it shall be attributed to the prior year only.

At least one Adult Lessee must be a Natural Person. (Decl. Sec. 18.7)

Occupancy of a leased Unit shall be limited to two (2) persons per bedroom. (Decl. Sec. 17.3)

An Owner requesting to lease his or her Unit must notify the Board at least thirty (30) days before the lease occupancy date and pay all outstanding Assessments and Special Charges, including fines prior to the Board or its designee approving the Lease. (Decl. Sec 18.7.1

Notification is made by submitting the required documentation in the “Dorchester Lease Packet” obtained from the Management Office. Required information includes:

• A “Temporary Membership Application for Lessee(s);”

• A copy of the proposed lease with no scratched out or written over information; • A non-refundable transfer fee of one-hundred dollars ($100); and

• The “Lessee’s Agreement to Abide by Dorchester Rules Document” signed by the Owner(s) and Lessee(s). (Decl. Sec 18.7.1)

The Board shall request and the prospective Lessee must provide, at his/her expense, information reasonably needed for a background check to be done by Management and answer questions relevant to the suitability of the Lessee. The prospective Lessee shall also participate in a telephone or personal interview with the Board or its designee, if he/she has not previously resided in the building.

Once all documentation is officially submitted to the Board or its designee, the Board or its designee must act on the proposed Lease within fifteen (15) days after receiving the last of the required notices, requested information and any interview. Disapproval of a Lease shall be based on a majority vote of the Board. (Decl. Sec. 18.7.2 & 18.7.3)

Upon approval of the Lease, the Board shall provide a “Certificate of Approval of Lease” to the Owner or Owner's agent.

Once a Lease is approved, the Owner or his/her agent shall be responsible for submitting the “Pelican Bay Lease Application” and “Approval of Tenants” forms to the Pelican Bay Foundation.

The Board shall disapprove a proposed lease if:

• The Lease fails to identify the names of proposed Residents, or the number of proposed Residents exceeds the permitted maximum (of two Occupants per bedroom);

• The Lease contains any other provision that is inconsistent with these Rules or the Declaration (such as allowing subleases or impermissible business activities, etc.);

• No proposed Lessee is a Natural Person;

• Charges or Assessments against the Unit are unpaid;

• The proposed Lessee has not provided the information or interview required to process the application, has made material misstatements or has withheld material information;

• The proposed Lessee or any other Adult to be Resident is a registered sex offender, or has pleaded to or been convicted of a felony involving violence, theft, arson or drug dealing in the past ten (10) years; or

• The proposed Lessee or any other Adult to be Resident has a history of disruptive behavior or disregard of the rights of others in a multi-family residence in the past three years. (Decl. Sec. 18.7.3)

If the Board disapproves a Lease, the Lease shall not be made. (Decl. 18.7.3)

Lessees must contact the Owner or Owner's agent for Unit repairs and questions, except in emergencies.
