1. Owners are permitted to keep domestic pets, specifically limited to one dog or one cat. All other animals are prohibited. Guests of owners are not allowed to bring pets onto the premises regardless of whether or not the owner has a pet.

2. Dogs must be on a leash when outside of the unit and on the grounds. Clean up after your dog or cat is required. Cats must use a litter box inside the unit. Pets are prohibited from the swimming pool area.

3. No pets shall be bred and no pets shall be maintained for commercial purpose.

4. Pets must be properly controlled at all times and should be exercised and curbed only in appropriate areas.

5. Lessees are not allowed to have pets of any kind. Their guests are not allowed to bring a pet onto the premises.

6. Pets shall be trained so that no neighbor is ever disturbed by barking, droppings, catcalls, attacks on other animals or any other disturbance.

7. When a complaint is made in writing to the Board, alleging a violation of any provision of these rules regarding pets, the Board shall investigate and review such complaints. Depending on the severity of the violation, the Board may impose such warnings, conditions or penalties deemed appropriate. The Board may also determine that the animal must be permanently removed from the Clam Court Marina property.

8. Owners currently in possession of a pet at Clam Court Marina at the time of the adoption of these rules (April 1 2017) are automatically given permission for their pet. Following this date, all owners must seek specific permission in writing from the Board to bring their pet onto the premises. New owners applying for membership have to gain permission from the Board prior to bringing their dog or cat onto the premises.

9. A Standing Committee has been formed to deal with complaints regarding dogs at Clam Court. This Standing Committee has three members. In the event of an informal or formal complaint to the Board of Directors the Committee will investigate. The Committee is required to report their findings and outcome to the Board of Directors. If a formal complaint is required following an informal complaint, the Committee will submit this Formal Complaint to the Board of Directors. The Formal Complaint process outlined in #7 above will be followed.

Any owner planning to lease his/her apartment must obtain the form, “Application for Membership”, from the Association. This form must be completed, signed and returned to the Association at least 15 days prior to occupancy. This form must be accompanied by a check for $100.00 (non-refundable) made out to Clam Court Marina Apartments Association, Inc. A signed acknowledgement regarding Rules and Regulations is also required. A personal interview by a Board member of the proposed lessee is also required for final approval. The Board of Directors reserves the right to approve a planned lease. If the Board does not approve a lessee, the reasons for this must be stated in writing to the owner.

Owners may lease their apartments only one time in a twelve-month period if a 12 month lease, or one time in a calendar year if less than full term. Leases may not be less than 90 days nor may they exceed one year or 365 days. Renewal of a lease with the same lessee requires written notice to the Board prior to renewal but does not require that an Application for Membership be processed again.

Lessees must be members of one immediate family. The Lessee must be in residence when houseguests are present. The members of Clam Court Marina Apartments Association, Inc. prefer no member of the immediate family is younger than 16. No Lessee may sublease the unit or any portion of the unit. The Lessee must be in residence when houseguests are present. Houseguests are limited to 15 consecutive days twice per year. The members of Clam Court Marina Apartments Association, Inc. prefer that houseguests do not include children under the age of 16.

LESSEES MAY NOT HAVE PETS OF ANY KINDS.
