No Home Owner, Tenant, or other occupant of a Home shall raise or breed any pet or other animal, livestock or poultry upon any portion of the Condominium Property. No Home Owner, invitee, Tenant, or other occupant of a Home is permitted to keep a domestic pet or animal in a Home, either temporarily or permanently, without the prior written permission of the Board. Such permission in one instance shall not be deemed to institute blanket permission in any other instance, and any such permission may be revoked at any time in the sole discretion of the Board. However, under no circumstances will any dog whose breed is noted for its viciousness or ill-temper, in particular, the “Pit Bull” (as hereinafter defined), Mastiff, Rottweiller, Presa Canario, or any crossbreeds of such breeds, be permitted on any portion of the Condominium Property. A “Pit Bull” is defined as any dog that is an American Pit Bull Terrier, American Staffordshire Terrier, Staffordshire Bull Terrier, or any dog displaying a majority of the physical traits of any one (1) or more of the above breeds, or any dog exhibiting those distinguishing characteristics, which substantially conform to the standards established by the American Kennel Club or Untied Kennel Club for any of the above breeds. No exotic pet or any animal of any kind which has venom or poisonous defense or capture mechanisms, or if let loose would constitute vermin, shall be allowed on any portion of the Condominium Property. Trained seeing-eye dogs will be permitted for those persons holding certificates of blindness and necessity. Other animals will be permitted if such animals serve as physical aides to handicapped persons, and such animals have been trained or provided by an agency or service qualified to provide such animals. The guide or assistance animal will be kept in direct custody of the assisted person or the qualified person training the animal at all times when on the Condominium Property, and the animal shall wear and be controlled by a harness or orange-colored leash and collar. Pets may not be kept, bred or maintained for any commercial purpose. Any pet must be temporarily caged, carried, or kept on a leash when outside of a Home. No pet shall be kept tied outside of a Home; and no pet shall be kept or left unattended on a Lanai. A Home Owner shall immediately pick up and remove any solid animal waste deposited by a pet on the Condominium Property. A Home Owner shall compensate any person or pet bitten or otherwise injured by the Home Owner’s pet, and shall indemnify the Association and hold it harmless against any loss or liability of any kind or character whatsoever arising from or growing out of having any animal within the Condominium Property. If a dog or any other animal becomes obnoxious to a Home Owner by barking or otherwise, its Home Owner shall cause the problem to be promptly corrected; or, if it is not corrected, the Home Owner, upon written notice by the Association, shall be required to permanently remove the animal from the Condominium Property.

If an Unaccompanied Guest will occupy a Home for more than 14 consecutive calendar days (an “Extended Unaccompanied Guest”), the Home Owner shall give the Manager with the registration application, (i) a security deposit of $500, which shall be held by the Manager on behalf of the Association, and may be used by the Association, in the same manner as a damage deposit is held and may be used for a lease of a Home (the “Occupancy Deposit”), (ii) an application fee of $100, and (iii) a $35 fee for a background check of each Extended Unaccompanied Guest 18 years of age or older. The Occupancy Deposit shall be returned to the Home Owner within 15 days of the date all Extended Unaccompanied Guests vacate the Home, unless the Occupancy Deposit is used to pay for repair of any damage to the Common Elements caused by an Extended Unaccompanied Guest.

The Board also may require a written occupancy agreement to be entered into with the Association by the Home Owner(s) and adult Extended Unaccompanied Guests, in a form and with such terms approved by the Board.
