• The owner of each unit may keep a reasonable number of pets in the unit. Any unit owner who keeps a pet or permits a pet to be kept in their unit, shall be liable for all damage or injury to persons or property caused by such a pet.

• The ability to keep pets is a privilege, not a right, and the Board of Directors is empowered to order and enforce the removal of any pet which becomes a source of unreasonable annoyance or danger to other residents of the community.

• Pets must be leashed, at all times while on the community property outside of the unit, and pet owners shall immediately remove any animal droppings left by the owner’s pet upon the common elements. The Association may establish and enforce fine for violations of this provision (see Collier County Animal Control Ordinance Sec 14-27).

• Renters may not keep pets (with the exception of 12-month annual renters).

• Residents may not feed feral and/or wild animals, fish, or birds per Collier County Laws.

• Prior to selling or leasing a unit, approval must be obtained from the Association. Forms and instructions are available at the Breakwater office or online: at www.breakwaterpelicanbay.com

• Leases must be for at least 30 days and a unit cannot be leased more than three times in a calendar year. Leases may not be for any period greater than 12 months in duration or include an option for renewal. However, approval for a new lease with the same lessee may be requested.

• No more than six (6) persons may occupy a unit, Declaration of Covenants 15.17.

• Lessees shall park motor vehicles in enclosed garages only, and not in garage tunnels or Guest parking spaces, Declaration of Covenants 15.2.2.c.

• Owners are responsible for communicating to lessees the Breakwater and Pelican Bay rules and guidelines. Unit owners will be held responsible for the actions of their lessees.

• Owners are responsible for addressing any violation of the rules engaged in by their lessees and may be held responsible for any such violation.
