The Unit Owner may keep up to two small pets (cats and dogs only), which do not exceed 25 pounds or one pet not to exceed 50 pounds. The Unit Owner may also have one fish aquarium (maximum 50 gallons). The pet(s) must be carried under the Unit Owner’s arm or be leashed at all times while on the Condominium property outside of the Unit. The ability to keep such a pet is a privilege, not a right, and the Board of Directors is empowered to order and enforce the removal of any pet which does not comply with this rule and/or which, in the judgment of the Board, becomes a source of annoyance to other residents of the Condominium. No pets of any kind are permitted in leased Units. No reptiles, rodents, amphibians, poultry or livestock may be kept at the Condominium. Unit Owners who walk their pets must clean up after their pets. Pets may not be left unattended or leashed on lanais, entries, Common Elements or in garages. No pets are allowed in the clubhouse, pool, spa or grill area. Unit Owners, Family, Guests and Invitees are prohibited from feeding feral animals at any time.

A. Any Unit Owner intending to lease his or her unit shall give to the Property Manager a completed “Avellino Isles Condominium Association Application for Lease” in addition to the fully executed copy of the proposed lease and a non-refundable processing fee of $ 150. Lease Applications are available on the Avellino website or through the Property Manager.

B. No pets are allowed in lease Units.

C. Failure to provide to the Property Manager a Unit alarm code, if applicable, along with a Unit key to allow for emergency entrance to an owner’s Unit shall be grounds for disapproval of the lease.

D. Prior to occupancy, the Lessee shall complete the forms “Notification of Non-Owner Occupancy” and “Avellino Isles Lease Addendum” and provide them to the Property Manager. These forms are available on the Avellino website or through the Property Manager.

E. By appointment, at the start of the lease, the new Lessee(s) are required to attend a mandatory meeting conducted by the Property Manager or his designee to communicate to the Lessee the Association’s ruling documents and to describe the facility and functions.

F. The Property Manager shall provide a written copy of these Rules and Regulations as well as copies of the Bylaws and Declaration of Condominium to each Lessee.

G. Should the Unit Owner be 25 days delinquent in paying association assessments, after written notification has been mailed to Owner and Lessee, all lease payments from the point forward shall be made by the Lessee to the Association directly and not to the Unit Owner, until such time as the Unit Owner has paid back assessments, late fees, legal fees and interest.

H. The Lessee(s) are responsible for their own actions and the actions of their Dependents and Guests. Any conduct in violation of the Association’s Rules and Regulations, Bylaws, or Declaration of Condominium may warrant the suspension of the Unit Owner’s and Lessee’s privileges. The Association may also institute legal action for which the Lessee and Unit Owner may be liable for attorney’s fees.

I. The Property Manager shall have the power to evict the Lessee without securing consent from the Unit Owner if lessee violates any of the Avellino Isles Rules and Regulations, Bylaws, or Declaration of Condominium.
