No Unit Owner is permitted to keep a domestic pet (dog, cat and other usual and non-exotic pets), whether permanent or temporary, in the Unit without the prior written permission of the Association.

The feeding or sheltering of any fowl, stray or wild animal is not permitted.

Canines and felines shall be permitted within the common areas only if carried or if on a leash. Pets are not permitted in the pool, pool cabana or gated pool area.

Up to two pets are permitted in any unit. All pets must have current vaccinations.

Pit bulls are not permitted within Arielle. Any animal that exhibits aggressive behavior should be reported and evaluated.

Tenants, both seasonal and annual, and their guests, are not permitted to have pets in Arielle. Curbing (i.e. pooper scooping) is required for all pets. Owners are required to clean up after their pets. Pet waste must be bagged and deposited in pet owner’s trash can. All pet waste must be removed immediately.

Pets may not be left unattended on a lanai or any common area or limited common area.

Prior to the closing on the purchase of a unit in Arielle, any prospective purchaser who wishes to bring a pet(s) into Arielle must present a letter to the property management company which indicates the name, weight and breed of the pet(s), and evidence that each pet is current with vaccinations. After closing, the owner is responsible for ensuring that the pets’ vaccinations are current. Upon request of the property management company, the pet’s owner will provide written evidence to such effect. Any owner who acquires a pet after the closing on the purchase of a unit in Arielle shall be required to comply with the requirements of this Section 6.

In order to foster a stable residential community, the leasing of units by owners shall be restricted as identified in this Section.

All rentals require prior approval by the Association, before becoming effective. Rental applications may be obtained by contacting the Property Manager.

A prescribed Lease Application form, a complete, fully executed copy of the Lease, a non-refundable application fee, payable to the Association, and a copy of the tenant’s drivers’ license(s), are to be submitted to the Association, in care of the Property Management firm, for review by the Association, not less than thirty (30) days prior to the proposed effective date of the Lease. In connection with the review process, the Property Management firm may conduct a background review of the proposed tenant(s).

Rentals are limited to:

• A minimum of 30 consecutive calendar days.

• A maximum of one year; and

• A maximum of 3 rentals per calendar year.

Rentals are to be only to the tenant(s) identified in the Lease, with no subtenants or unnamed co-tenants. Rentals must be leased to natural persons only; Leases to non-natural persons (including without limitation corporations, partnerships, LLC’s, trusts, or any other entity) are not permitted. The following rental arrangements are strictly prohibited: (1) Any assignment of the Lease without the submission to the property manager of a copy of the proposed Assignment, and the prior written approval by the Association of the proposed assignee: and (2) any Subletting, or the agreement of the tenant to allow use and occupancy of the leased unit by parties other than the tenant identified in the Lease for all or any portion of the term of the Lease.

Rentals without the prior written approval of the Association, or any other violation of the terms and conditions of this Section 11, may result in eviction of the tenant and/or a fine against the owner of up to $1,000 per occurrence.

Security gate passes and authorization by the Foundation of Pelican Marsh cards for admission and use of the to the Pelican Marsh Community Center, are available from the Manager of the Foundation at Pelican Marsh, at the Community Center. Please contact the Foundation office located at the Community Center to obtain the necessary approvals.

Each owner shall provide a copy of these Rules and Regulations to all tenants at or prior to entering a Lease for such owner’s unit and require the tenant to execute an acknowledgement that it received the copy, which acknowledgement shall be provided to the property manager.

A copy of these Rules and Regulations must always be available in each unit, for review by tenants.

Tenants are required to comply with these Rules and Regulations and are liable for all fines and any legal and other fees associated with any violation of these Rules and Regulations by the tenant. Owners will be held responsible for the actions of their tenants, including the payment of any fines levied against, but not paid by, such tenants.
