a. Pets are to be walked in designated areas only.

b. Under no circumstances may any exotic pets, such as snakes or other reptiles, rodents or any breed of dog commonly know as “pit bull” or any aggressive dog be permitted on any portion of the condominium property.

c. Owners shall be limited to two pets per unit, with strict behavioral criteria. All pets shall be registered with the Association. Visitors and renters must follow pet rules.

d. Pet Sitters: Pet sitter, visitor and/or vendor hired or scheduled to care for your pet(s) while you are not in residence must follow all rules regarding pets.

e. Unit owners must leave their pet sitters name at the front desk to authorize sitter access into the building, prior to their arrival.

f. Unit owners shall notify pet sitters on use of the gate access authorization system.

Pet Behavior Criteria

a. The pet shall not make disturbing noises such as barking or crying that interfere with other residents’ quiet enjoyment of the property.

b. The pet shall not be permitted to damage any common or limited common area of the property.

c. When using permitted areas, owners will clean up after their pets and properly dispose of waste in the pet waste receptacles provided, every time without exception. Pet waste receptacles are provided at the NE, SE and NW sides of the building.

d. The owner will obey any and all use and health regulations concerning pets on the property. No pets are permitted on the upper deck, pool deck or marina pavilion, except for designated pet friendly areas.

e. Pets must always be securely leashed whenever outside of the Owner’s unit. No pet shall be allowed to run free for any amount of time, whether indoors or outdoors, in any of the common areas except in the dog park.

f. No pet shall behave in any fashion, which reasonably disturbs the enjoyment of the property by owners and their guests.

g. Pets are not allowed in the passenger elevators, fitness room, theater, social room, library, sky lounge, club aqua, game room or guest suites.

h. Unit Owners when with their pets, should enter and exit the building using the garage level. Access to the gated dog park (east side of South Tower) is via service elevator and service hallway exit doors. Same in North Tower; via service elevator and service hallway exit doors-across front entrance parking circle. Unit Owners when with their pets, must use the service elevators only. Pets may not be taken through the lobby level, unless being always carried except during fire alarms and other emergency situations.

i. The outdoor seating area located on the lower pool deck near the North Tower fire pit and pool restrooms, is designated as a pet friendly area. Owners are welcome to sit outside with their pets in this designated area, provided all other above criteria is followed and pets are always securely leashed,

j. A designated gated dog park is located on the east side of the South Tower where pet’s leash is not required but recommended.

k. Aggressiveness, viciousness, biting or any other behavior causing injury to any persons, shall be grounds for immediate removal of the pet form the property without notice requirement below.

l. If an owner’s pet behaves in a fashion, which violates the behavioral criteria, the Board is permitted to exercise the following remedies:

• On the FIRST offense, the owner will be contacted via Board initiated phone call to advise owner of pet behavior criteria and ask the behavior to be changed.

• On the SECOND offense, the Board will send written notice to the owner via registered mail asking that the behavior be changed.

• If a THIRD offense occurs during any twelve-month period, the Board of Directors may vote to order the pet removed permanently from the community at any regularly scheduled meeting via simple majority vote of the Board.

a. To All Owners/Residents must complete and return to the Association a Purchase/Lease Data Sheet for Association approval.

b. Any Unit Owner requesting to lease or sell his/her unit must submit a Resales/Lease Application accompanied with a check in the amount of $100 (one-hundred dollars) made payable to: Aqua at Pelican Isle Condominium Association, Inc. at least ten (10) business days prior to the effective date of proposed sale or lease.

c. Estoppel Fees of $250 (two hundred and fifty dollars) for resales are due prior to the release of any information.

d. Mortgage Questionnaire Fees of $150 (one hundred and fifty dollars) is due prior to the release of any information.

e. NO for Sale, For Rent or For Lease signage or any other type of promotional marketing shall be posted on the premises of any Unit or property.

f. Broker Open Houses can be scheduled upon approval of the General Manager.

g. Realtors and/or Realtor personnel are encouraged to greet perspective buyers in the lobby and escorted to unit.

h. Any Realtor conducting a Sunday Open House from 1:00pm to 4:00pm, may post a temporary open house sign during this time frame only at the median/roadside by the AQUA entrance. The sign to include Agency’s Name, Realtor’s Name and Phone Number.

i. When showing the common areas on the amenity level, shut off all lights when you leave each room.
